Ask AAP: Reducing an appointment?

Q: An Academic Professional is paid partly by the state ("hard money") and partly with research contract funds ("soft money"). He found out recently that last August his term of appointment was changed from twelve months to nine.

Isn't he due the type of notice given to people who are terminated?

A: There are many complexities and ambiguities here, involving the date of notification, the two sources of funds, this person's length of service, and whether change in status of employment is equivalent to non-reappointment situations. The UIUC Academic Staff Handbook deals only with non-reappointment situations. One can only assume that the notices given in non-reappointment cases also apply to changes in the terms of appointment, but no official policy exists.

Page 52 of the handbook lists the minimum interval required for notice of non-reappointment. For those on soft funds this ranges from two to twelve months, depending on years of full-time service. Presumably someone on 50% hard funds could insist on a longer notice period for half the job.

Since University employees no longer receive a hard copy of their notice of reappointment, they must look up details in NESSIE, under "Your File," then "Notification of Appointment." The dates there are puzzling: when one of us looked under the heading "Appointment Information As Of" the date "06-04-1999" appears, but the contract started last August. Similarly, under "Period of Payment Eff. Date" the date "05-21-1999" comes up, even though the current contract became effective last August.

Is it possible that the information is wrong? If not, what does the date mean? There should be detailed explanations next to those dates so that one will know whether the information posted there is correct.
